Without prejudice to Article 3(2), when establishing or maintaining sanitary or phytosanitary measures to achieve an adequate level of sanitary or phytosanitary protection, Members shall ensure that, having regard to technical and economic feasibility, such measures are no more restrictive for trade than for achieving their adequate level of protection of health or phytosanitary. This Convention shall not affect the rights of Members under other international agreements, including the right to use the good offices or dispute settlement mechanisms of other international organizations established under an international agreement.
